A new tax, in force since 2026
Since 1 January 2026, Belgium applies a 10% tax on capital gains realised on the disposal of financial assets (shares, bonds, ETFs, crypto-assets, currencies, investment gold).
The reference value mechanism
For an asset held before the law came into force, only the capital gain accumulated from 31/12/2025 onwards is taxable, but a capital loss that occurred before that date cannot be deducted.
What this calculator does not do
It is limited to assets with a simple calculation formula (shares, bonds, ETFs, crypto, currencies, gold). It does not calculate the multi-year carry-forward mechanism for the exemption, nor derivatives or branch 21/23 insurance contracts.
Frequently asked questions
Where does this tax come from and is it really in force?
Yes. The law was passed in plenary session at the Chamber of Representatives during the night of 3 to 4 April 2026, then published in the Belgian Official Gazette on 21 April 2026. It applies retroactively to all disposals made since 1 January 2026.
What is the "reference value" and why doesn't it protect my old losses?
For an asset acquired before 1 January 2026, the law uses the higher of your original purchase price and the asset's value on 31/12/2025, so as not to tax capital gains accumulated before the law came into force. But if the value on 31/12/2025 was lower than your purchase price, you cannot deduct that historical loss: you then use your original purchase price.
Can I deduct this year's losses?
Yes, capital losses realised in the same year are deductible from that year's capital gains, before applying the annual exemption.
What is the carry-forward mechanism for the exemption, and why isn't it calculated here?
The law allows up to €1,000 of unused exemption per year to be carried forward, over a 5-year window, with a cumulative cap of €15,000. This multi-year tracking depends on your complete history from previous years, which this tool cannot reconstruct, only the simple annual €10,000 exemption is calculated here.
Does this tax apply to crypto-assets and currencies?
Yes, unlike the stock exchange tax (TOB) which only targets classic securities, the capital gains tax also includes crypto-assets, currencies and investment gold.
